COURSE OVERVIEW:

The International Federation of Consulting Engineers (FIDIC) provides the world’s most widely used standard forms of contract for international construction and infrastructure projects. This course provides a sophisticated exploration of the Terms and Conditions of FIDIC Contracts, focusing on the 1999 and 2017 "Rainbow Suite" (Red, Yellow, and Silver Books). It addresses the strategic importance of understanding the "Risk Allocation" framework between the Employer, the Contractor, and the Engineer to ensure successful project delivery and dispute avoidance.

 

The scope of this training encompasses the technical application of "General Conditions," the drafting of "Particular Conditions," and the management of "Contractual Claims." Participants will learn how to navigate the "Engineer’s Duties," manage "Variation Procedures," and implement the "Dispute Avoidance/Adjudication Board" (DAAB) processes. The course provides practical tools for "Contract Administration," "Payment Mechanisms," and the management of "Taking Over" and "Defects Liability" periods.

 

Coverage includes the analysis of "Force Majeure" (Exceptional Events), the implementation of "Termination" and "Suspension" clauses, and the execution of "Financial Procedures" under FIDIC. Attendees will explore the legal nuances of "Design Responsibility" and learn how to manage the "Claims and Disputes" procedures under Clause 20 and Clause 21. By mastering the terms and conditions of FIDIC contracts, professionals will be able to manage international projects with legal certainty, protect their organization’s commercial interests, and resolve conflicts through standardized global protocols.

TRAINING COURSE METHODOLOGY:

A highly interactive combination of lectures, discussion sessions, and case studies will be employed to maximize the transfer of information, knowledge, and experience. The course will be intensive, practical, and highly interactive. The sessions will start by raising the most relevant questions and motivating everybody to find the right answers. The attendants will also be encouraged to raise more of their questions and to share in developing the right answers using their analysis and experience. There will also be some indoor experiential activities to enhance the learning experience. Course material will be provided in PowerPoint, with necessary animations, learning videos, and general discussions.

 

The course participants shall be evaluated before, during, and at the end of the course.
