Resolving Contract Disputes And Avoiding Construction Claims

06 – 10 Apr. 2026, Dubai06 – 10 July 2026, Abu Dhabi

COURSE OVERVIEW:

In the complex and often adversarial world of construction, the ability to manage claims and resolve disputes is essential for protecting project margins and maintaining professional relationships. This course provides a sophisticated framework for the systematic identification, analysis, and mitigation of construction claims and disputes. It focuses on the strategic importance of proactive "Claim Avoidance" and the utilization of robust "Contract Administration" to minimize legal exposure.

The scope of this training encompasses the technical analysis of "Delay and Disruption," the quantification of "Loss and Expense," and the application of "Alternative Dispute Resolution" (ADR) mechanisms. Participants will learn how to draft "Contractual Notices," build defensible "Claim Files," and navigate the complexities of "Concurrent Delay." The course provides practical tools for "Conflict De-escalation" and the management of formal "Adjudication," "Mediation," and "Arbitration" processes.

Coverage includes the analysis of "Claim Causation," the implementation of "Contemporaneous Record-Keeping," and the execution of "Forensic Delay Analysis." Attendees will explore the legal principles of "Standard Forms of Contract" (such as FIDIC and NEC) and learn how to negotiate "Amicable Settlements." By mastering dispute resolution and claim avoidance, professionals will be able to safeguard their organizations from costly litigation and ensure that project close-outs are conducted with commercial and legal integrity.

COURSE OBJECTIVES:

After completion of this course, the participants will be able to:

  • Identify the "Root Causes" of construction claims and disputes.
  • Implement a proactive "Claim Avoidance Strategy."
