COURSE OVERVIEW:

The International Federation of Consulting Engineers (FIDIC) forms of contract are the global standard for international construction and infrastructure projects, providing a balanced risk allocation between owners and contractors. This course provides a comprehensive and practical analysis of the FIDIC suite of contracts, focusing on the rights, obligations, and procedures defined within these forms. it emphasizes the operational application of FIDIC conditions to ensure smooth project delivery and effective dispute management.

 

The scope of this training encompasses the most widely used FIDIC books, including the Red (Construction), Yellow (Plant and Design-Build), and Silver (EPC/Turnkey) books, with a focus on the 2017 updates. Participants will learn how to navigate the complex clauses related to payment, variations, claims, and termination, as well as the unique role of the Engineer under FIDIC. The course also provides a detailed examination of the dispute resolution pathway, from the Dispute Avoidance/Adjudication Board (DAAB) to the final stage of international arbitration.

 

Coverage includes the legal principles underlying FIDIC conditions, the management of time-bars, and the preparation of required notices and reports. Attendees will explore real-world case studies to understand how FIDIC clauses are interpreted by arbitral tribunals and courts. By mastering FIDIC contract conditions and the arbitration process, professionals will be equipped to manage international projects with a high degree of contractual certainty and professional competence.

  • Navigate the FIDIC claims procedure for both time and money.
  • Utilize the Dispute Avoidance/Adjudication Board (DAAB) effectively.
  • Manage the suspension and termination protocols under FIDIC conditions.
  • Understand the interface between FIDIC conditions and local laws.
  • Prepare for and participate in the international arbitration process.
  • Execute the requirements for project completion, tests, and taking over.
  • Manage the defects notification period and final performance certificates.

This course is intended for Project Directors, Contract Managers, Legal Counsel, Engineers, Quantity Surveyors, and Senior Executives involved in international construction projects.

 

TRAINING COURSE METHODOLOGY:

A highly interactive combination of lectures, discussion sessions, and case studies will be employed to maximize the transfer of information, knowledge, and experience. The course will be intensive, practical, and highly interactive. The sessions will start by raising the most relevant questions and motivating everybody to find the right answers. The attendants will also be encouraged to raise more of their questions and to share in developing the right answers using their analysis and experience. There will also be some indoor experiential activities to enhance the learning experience. Course material will be provided in PowerPoint, with necessary animations, learning videos, and general discussions.

 

The course participants shall be evaluated before, during, and at the end of the course.
