COURSE OVERVIEW:

In the high-stakes environment of construction, the ability to manage claims and navigate the arbitration process is essential for protecting financial interests and project viability. This course provides an advanced exploration of the legal and technical frameworks used to identify, document, and resolve construction disputes. It focuses on the proactive management of claims to avoid escalation while preparing for the complexities of formal arbitration should negotiations fail.

 

The scope of this training encompasses the most common triggers for claims, including delays, disruptions, and differing site conditions, and provides methodologies for the quantitative analysis of time and cost impacts. Participants will learn how to build a robust claim file that meets the evidentiary standards required in legal proceedings. The course also addresses the procedural aspects of international arbitration, examining the roles of arbitrators, the rules of evidence, and the enforcement of final awards.

 

Coverage includes the interpretation of standard contract forms such as FIDIC regarding dispute resolution, the use of forensic schedule analysis, and the application of various claim valuation methods. Attendees will explore alternative dispute resolution (ADR) techniques like mediation and adjudication to settle conflicts early. By the end of this course, professionals will be equipped with the strategic and tactical skills necessary to defend their organizations against meritless claims and successfully pursue legitimate contractual entitlements.

TRAINING COURSE METHODOLOGY:

A highly interactive combination of lectures, discussion sessions, and case studies will be employed to maximize the transfer of information, knowledge, and experience. The course will be intensive, practical, and highly interactive. The sessions will start by raising the most relevant questions and motivating everybody to find the right answers. The attendants will also be encouraged to raise more of their questions and to share in developing the right answers using their analysis and experience. There will also be some indoor experiential activities to enhance the learning experience. Course material will be provided in PowerPoint, with necessary animations, learning videos, and general discussions.

 

The course participants shall be evaluated before, during, and at the end of the course.
