COURSE OVERVIEW:

Tanker Charter Parties and Maritime Law Awareness is a specialized program designed for maritime professionals who operate within the high-stakes liquid bulk sector. This course examines the intricate legal relationship between Shipowners and Charterers, focusing on the standardized contract forms used in the oil, chemical, and gas trades. It provides a technical framework for understanding how maritime law governs the transport of hazardous cargoes and the liabilities arising from incidents at sea.

 

The scope of this training involves a deep dive into industry-standard forms such as ASBATANKVOY, SHELLVOY, and BEEPEEVOY. Participants will explore the mechanics of "Seaworthiness" in the context of vetting (SIRE), the legalities of "Cargo Shortages" and "Contamination," and the financial implications of "Bill of Lading" disputes. The program emphasizes the practical application of the Hague-Visby Rules and the York-Antwerp Rules to modern tanker operations.

 

Coverage includes the analysis of "Pollution Liability" (CLC and FUND conventions), the management of "Letters of Protest," and the resolution of disputes through maritime arbitration. The course addresses the nuances of "Safe Port" warranties and the legal impact of environmental regulations like MARPOL on charter party performance. By focusing on both contractual language and case law, this course equips maritime leaders with the expertise needed to mitigate legal risk and defend the commercial interests of their vessels.

 

COURSE OBJECTIVES:

After completion of this course, the participants will be able to:

1.  Identify the primary types of Tanker Charter Parties and their commercial uses.

2.  Interpret key clauses in ASBATANKVOY and SHELLVOY forms.

3.  Define the "Owner's Warranty" regarding vessel description and speed/consumption.

4.  Execute the legal requirements for a valid "Notice of Readiness" (NOR).

5.  Manage "Cargo Claims" related to contamination, heating, and ROB (Retention On Board).

6.  Understand the legal implications of the "Bill of Lading" in the tanker trade.

7.  Apply the Hague-Visby Rules to cargo liability and exemptions.

8.  Evaluate "Safe Port" and "Safe Berth" warranties in high-risk regions.

9.  Manage "Pollution Liability" and the role of P&I Clubs in tanker incidents.

10.  Navigate the "General Average" process under the York-Antwerp Rules.

11.  Draft effective "Letters of Protest" (LOP) to protect the ship’s legal position.

12.  Utilize "Arbitration" and "Mediation" for resolving charter party disputes.

13.  Lead the bridge and shore teams in maintaining legal compliance during a voyage.

TRAINING COURSE METHODOLOGY:

A highly interactive combination of lectures, discussion sessions, and case studies will be employed to maximise the transfer of information, knowledge, and experience. The course will be intensive, practical, and highly interactive. The sessions will start by raising the most relevant questions and motivating everybody to find the right answers. The attendants will also be encouraged to raise more of their questions and to share in developing the right answers using their analysis and experience. There will also be some indoor experiential activities to enhance the learning experience. Course material will be provided in PowerPoint, with necessary animations, learning videos, and general discussions.

 

The course participants shall be evaluated before, during, and at the end of the course.

National Consultant Centre for Training LLC (NCC) will issue an Attendance Certificate to all participants completing a minimum of 80% of the total attendance time requirement.
